one of Mexico's best daily newspapers, it states on p. 18
(translated):
TRANSGENICS CAUSE OF CITIZENS LEGAL ACTION
Greenpeace Mexico presented this Thursday a citizens judicial claim
against the Secretariat of Health for permitting GMO corn from the
U.S. into our country without having realized risk evaluations for
human health and without having issued any notification to the society
at large [public]... The ecology group also realized a similar action
against the Secretariat of Agriculture but that agency responded by
denying Greenpeace Mexico's judicial capability to demand fulfillment
of the fito-sanitary legislation.
My guess is that the Secretariat of Agriculture is likely to lose in
court on that regard, but I'll have to check the most recent law,
which doesn't seem to be among the 40 pdf files of Mexican laws I have
installed. I do have the whole list of federal laws in html with the
url for each and will pull the fito-sanitary law down right now. The
ecology law I already have.
There is also a LEY FEDERAL DE VARIEDADES VEGETALES I'll need.
This action taken sounds like a formal notification to force federal
authorities to act in congruence with existing laws. Having consulted
for the Secretariat of Health I know the health legislation and by law
anyone can do this. Since the Secretariat of Health is responsible for
applying Mexico health laws, they are obligated to receive any and all
notifications of infractions and give them due course. Any failure to
do so on their part would put the matter in the hands of the Supreme
Court. The Secretariat of Health *must* consider the over-riding
public interest in terms of health, while the Secretariat of
Agriculture is production oriented and has only to report to and
coordinate with the Secretariat of Health where health matters are
concerned, although this is something that is not generally done to
the letter of the law.
The Secretariat of Ecology is likely to be legally involved here also,
and I assume that Greenpeace Mexico will follow up on that in an
appropriate manner.

The word genetic doesn't appear in the federal ecology legislation,
but on searching for "research", in the section dealing with:
"la formulación del ordenamiento ecológico,
it states that:
se deberán [should] considerar los siguientes [the following]
criterios:
As you can see, there's practically now difference between English
and Spanish. Well, se deberán is you should and los siguientes is
the following - The following criteria should be considered.
And in the first of 7 extensions of Article 20 of that section there's
a reference to:
... la Secretaría deberá promover la participación de grupos y
organizaciones sociales y empresariales, instituciones académicas y de
investigación, y demás personas interesadas, de acuerdo con lo
establecido en esta Ley, así como en las demás disposiciones que
resulten aplicables.
That's nice. Now this is in reference to formulating the regulations -
what about reformulating? It's got to be in the Planning Law - a 9
page law. Here's part of it.
CAPITULO III
Participación social en la planeación
Artículo 20
Basically, they have to consult with everyone - researchers, social
groups, farmers, workers, NGOs and legislators have to be there.
En el ámbito del Sistema Nacional de Planeación Democrática tendrá
lugar la participación y consulta de los diversos grupos sociales, con
el propósito de que la población exprese sus opiniones para la
elaboración, actualización y ejecución del Plan y los programas a que
se refiere esta Ley. Las organizaciones representativas de los
obreros, campesinos y grupos populares; de las instituciones
académicas, profesionales y de investigación; de los organismos
empresariales; y de otras agrupaciones sociales, participarán como
órganos de consulta permanente en los aspectos de la planeación
democrática relacionados con su actividad a través de foros de
consulta popular que al efecto se convocarán. Asimismo, participarán
en los mismos foros los diputados y senadores al Congreso de la Unión.
Very good. So this is for ongoing things.
Para tal efecto, y conforme a la legislación aplicable, en el Sistema
deberán preverse la organización y funcionamiento, las formalidades,
periodicidad y términos a que se sujetarán la participación y consulta
para la planeación nacional del desarrollo.

The *name* of the ecology law is:
Ley General del Equilibrio Ecológico y la Protección al Ambiente.
General [Federal] Law on Ecological Equilibrium and Environmental
Protection. The basis is there to do what needs to be done. The law
goes on to spell it all out.
I've worked with this law before, but it's been 10 years.
Here's the first article: Don't read on if you can't decipher it - but
it's just one article with 10 fractions, is a very nice law and the
important words are almost just like English, which most of you
already speak - to a degree. I translated the words least like those
in English at least once.
Artículo 1
[In] La presente Ley ... se refieren a la preservación y restauración
del equilibrio ecológico, así como a la protección al ambiente, en el
territorio nacional ... Sus disposiciones son de orden público e
interés social y tienen por objeto propiciar el desarrollo sustentable
[sustainable] y establecer las bases para:
I.- Garantizar el derecho de toda persona a vivir en un medio ambiente
[environment] adecuado para su desarrollo [develpment], salud [health]
y bienestar [good state of existence];
II.- Definir los principios de la política ambiental y los
instrumentos para su aplicación;
III.- La preservación, la restauración y el mejoramiento [improvement]
del ambiente;
IV.- La preservación y protección de la biodiversidad, así como el
establecimiento y administración de las áreas naturales
protegidas [protected];
V.- El aprovechamiento sustentable, la preservación y, en su caso, la
restauración del suelo [earth], el agua [water] y los demás [other]
recursos [resources] naturales, de manera que sean compatibles la
obtención [obtaining] de beneficios [benefits] económicos y las
actividades de la sociedad con la preservación de los ecosistemas;
VI.- La prevención [prevention] y el control de la contaminación del
aire, agua y suelo;
VII.- Garantizar [guarantee] la participación corresponsable de las
personas, en forma individual o colectiva, en la preservación y
restauración del equilibrio ecológico y la protección al ambiente;
VIII.- El ejercicio de las atribuciones que en materia ambiental
corresponde a la Federación, los Estados, el Distrito Federal y los
Municipios, bajo el principio de concurrencia previsto en el artículo
73 fracción XXIX - G de la Constitución;
.IX.- El establecimiento [establishment] de los mecanismos de
coordinación, inducción y concertación entre autoridades, entre éstas
y los sectores social y privado, así como con personas y grupos
sociales, en materia ambiental, y
X.- El establecimiento de medidas de control y de seguridad para
garantizar el cumplimiento [compliance] y la aplicación de esta Ley y
de las disposiciones que de ella se deriven [derived], así como para la
imposición de las sanciones administrativas y penales que
correspondan. En todo lo no previsto en la presente Ley, se aplicarán
las disposiciones contenidas en otras leyes relacionadas con las
materias que regula este ordenamiento.
