GMOs and FIFRA

Throwing this out there for discussion....

How are GMOs currently regulated? Could those GMOs created for pest control
measures, including the Round-Up Ready varieties even though their resistance
is to an herbicide, be regulated under FIFRA? Though a highly imperfect
solution, if they could be listed under FIFRA they would fall under the
provisions of the act including labeling, certification for application
(planting and management?), record keeping, and GMO drift could be treated,
perhaps, as an off-target application and subject to fines. Also under
FIFRA, states can require more stringent restrictions than those approved at
the federal level which would mean grassroots at the state and regional level
could potentially have an impact within their locale by rallying support for
greater state restrictions. The obvious downside is what I mentioned
previously--it is an imperfect solution largely because the penalties under
FIFRA are so weak, and because stringent and effective enforcement of the
provisions of the act is spotty. Also, temporary measures such as this (I
personally feel that GMOs need their own regulatory act on the order of the
Clean Water Act or Clean Air Act given their potential impact on the
environment and society) tend to become permanent solutions.
