They have "APPLIED" for the patent-they do not have the patent. The US the
patent examiners are now very, very leery of this kind of patent. I would
not put money on them getting it in the US. Patents on natural plant and
animal products are difficult to obtain, the result of an attempt by the US
PO to stem the tide of gene and plant patents.
I just went through this for the last 9 months and I had to demonstrate not
only that the rhea had more of the particular factor, ATP, but that my
process enhanced the natural properties inherent in the meat of the bird not
obtainable by eating a rhea steak. In my first patent two years ago I only
had to demonstrate how the oil was different from the other previously
patented similar substances.
