The proposed National Organic Program regulations would not, as
written, permit the use of "biosolids" in organic agriculture. There is no
intent expressed in the regulations or in the preamble to contradict the
NOSB's recommendation concerning biosolids, in which they concluded
that this substance should be considered to be synthetic and should not
appear on the National List. The list of substances reviewed that were
determined to be non-synthetic (on pg. 65888) does not include
biosolids, nor did the USDA opt to include biosolids on the Proposed
National List in contradiction to the NOSB's recommendations.
The preamble does, at the request of EPA, request public comment as to
whether biosolids (municipal sludge) should be permitted or prohibited
for organic production, and whether they should be classified as
synthetic. The public has spoken very clearly on this, and it is being
heard.
